Well, a few months after the motherboard on our Dell computer fried we are finally getting somewhere. My Dell laptops motherboard fried a couple of months after the warranty. Dell obviously refused to repair this and trying to talk to anyone that know anything on their stupid phone service system is a mission so knowing my rights i filed a case with the Disputes Tribunal as i know that under the consumer guarantees Act in New Zealand paying for an extended warranty means you are paying for something you already have. You don’t need to buy the extended warranty as you are covered under the Consumer Guarantees Act which states that a product must last for a reasonable amount of time.
Well Dell rung me the day before the court case was due and offered to pay for the repair. I’m not sure if this is because they knew they would loose the case or not but i decided to go down this road as it saves us both time having to go to court. I am still waiting for the refund however and you never know. I may have to go to Disputes Tribunal to actually get them to pay. Aaaah don’t ya just love dealing with this company. They have got to have the worst customer service i have come across.
I urge anyone that has a problem with Dell that is covered by the Consumer Guarantees Act to take Dell to the Disputes Tribunal and recover your costs. This company must rely on the fact that people can’t be bothered to act. Going to the Disputes Tribunal is not that hard at all. Just fill out the form you get from the Courts and file it with copies of your evidence. I would also include any articles you happen to have on hat you are entitled to under the Act. The website www.consumer.org.nz has a brilliant article about how long products should last for and what your rights are. This will help back your claim. Dell needs to learn that they have to respect the Consumer Guarantees Act and they DO have to do what the Act says. You can not contract out of the Act.
